Leave Legacy

Although Sharia Law prescribes how you leave 2/3 thirds of your wealth, you are free to dispose of the remaining 1/3 as you wish. Leave a gift in your Will for the Al-Ansari Foundation and we will use it positively to help change the lives of children on our projects. Your gift will increase their educational opportunities and help build a better future for them. This is your legacy and it will survive you even after your death. In Islam a gift such as this constitutes Sadqa-e-Jariya, which means a voluntary form of charity that continues even after a person dies. This is one of the three things in Islam that will benefit a Muslim after his death.

Why leave a Will?

In English Law you will be deemed to have died intestate if you do not leave a will. Your family will not decide how your wealth is divided but the State, which inevitably means that your wealth will not be divided in accordance to Sharia Law. Apart from the legal consequences, Muslims have an obligation to leave a Will and there are many evidences for this. It is narrated for instance that 'Malik related to me from Nafi‘ from ‘Abdullah ibn ‘Umar that the Messenger of Allah, may Allah bless him and grant him peace, said:

“It is the duty of a Muslim who has anything to bequeath not to let two nights pass without writing a Will about it.” (Al-Muwatta’ of Imam Malik)

What happens to my young children?

There are more serious consequence for parents who die without a will. Your Will is the only legal document in which you can nominate a guardian for your children.  There is no easy way to determine who gets custody if you die without a Will. Your children could wind up at the centre of an ugly court battle, be left with a relative who does not really want them or, in the worst-case scenario, be placed in the foster care system.

The number of children removed and placed into foster care by the government is on the increase. In total, between April 2011 and January 2012 Children and Family Court Advisory Service received 8,403 new applications to remove children. Sadly, a proportion of these children will be removed because their parents died without making a will and identifying a guardian for their children.
